Your privacy is important to us. We want you to understand the terms and conditions surrounding the capture and use of any information we gather. To that end, this privacy policy is to set out the principles governing how we collect, use, disclose and protect your personal information and we ask you to read this privacy policy carefully.

Personal Information Collection and Use

Perceptive Group Limited (“we” or “us”) gather various types of information, including information that identifies or may identify you as an individual (“Personal Information”).

Collection

We collect any:

  1. Personal information provided by you when you interact with us, when you use or purchase our products or services, when you subscribe or register to use our products or services, and when you provide us with your feedback or respond to surveys you are asked to participate in; 
  2. Aggregated information automatically (device’s IP address, referring website, what pages your device visited, and the time that your device visited our Website) such as generated by our systems or third-party systems we use, which track traffic to and from our sites. For further information, please read the section below headed “Cookies and other Tracking Technologies”; and 
  3. Other information that does not personally identify you.  Failure to provide necessary personal information when requested may result in certain services not being available to you. 

How do we use the information?

We will use the information we collect via our Products and Services (Websites, surveys,):

  1. To administer our services, and for internal operations, including troubleshooting, data analysis, testing, and statistical purposes;
  2. To improve our Website to ensure that content is presented in the most effective manner for you and for your computer;
  3. For trend monitoring, marketing and advertising;
  4. For purposes made clear to you at the time you submit your information – for example, to provide you with information you have requested about our Services; and
  5. As part of our efforts to keep our Website secure.

Our use of your Personal Information may be based on our legitimate interest to ensure network and information security, and for our direct marketing purposes, or you consenting to it. For our customers, the use of personal data will be based on the contract we have in place.

Disclosure of Information 

We may disclose: 

  1. All information that we gather, including your personal information, to our related companies;
  2. Aggregated tracking information and other information that does not personally identify you to third parties;
  3. Your personal information to third parties when we believe in good faith that we are required to do so by law;
  4. Your personal information to other third parties provided we have your prior authorisation, which we will usually obtain at the time of collecting the information from you.

Cookies and Other Tracking Activities

A cookie is a small piece of data (text file) that a website – when visited by a user – asks your browser to store on your device to remember information about you, such as your language preference or login information. Those cookies are set by us and called first party cookies. We also use third party cookies – which are cookies from a domain different than the domain of the website you are visiting – for our advertising and marketing efforts.

More specifically, we use cookies and other tracking technologies for the following purposes:

  1. Track traffic patterns to and from our sites such as the pages you visit, the time you spend on each page, the date and time of your visit, where your mouse hovers, and referring pages (pages you came from or go to);
  2. Ensure advertising is being shown to the most appropriate person and limit the frequency of display for certain ad formats; and
  3. Enable you to use certain services as a member without having to log on each time and to visit member-restricted areas of the site.  

We may allow third-party companies to serve ads and/or collect certain information when you and other Internet users visit our websites. These companies may use non-personally identifiable information (e.g. click stream information, browser type, time and date, subject of advertisements clicked or scrolled over) and precise geo location and user device identification (if you have provided your consent to us) during your visits to this site and other websites in order to provide advertisements about goods and services likely to be of greater interest to you.

We also contract with online measurement companies and other service providers to manage and optimise our Internet business and communications. These companies collect information about visits to our site to assist us in analysing the site's performance and advertising effectiveness and optimising the site for readers and marketers.

These companies typically use a cookie or other technology to collect this information. The companies may provide a mechanism to opt-out of their technologies. Clear gifs are tiny graphics with a unique identifier, similar in function to cookies. Clear gifs may ping or alert an advertiser's server about the online movements of Web users. For instance, advertisers may place a clear gif allowing them to recognise an existing cookie on your browser if from the same service. The main difference between cookies and clear gifs is that clear gifs are invisible on the page and are much smaller. We do not have access to any information collected by these clear gifs nor additional information they may be tied to by the advertiser.

Analytics

Analytics 

Perceptive Group Ltd or our related companies contract with online measurement companies and other service providers to manage and optimise our Internet business and communications. These companies collect information about visits to our site to assist us in analysing the site's performance and advertising effectiveness and optimising the site for readers and marketers. Details of these our analytics tools and the information they may collect can be found below.

Google Analytics

Google Analytics is the most widely used website statistics service globally. It collects anonymous information to provide Perceptive Group Ltd with data about how people are using Perceptive Group Ltd websites, including details about website traffic and website performance.

Google Analytics is implemented with page tags that collect information when visitors view a Perceptive Group Ltd website. Google Analytics may also use cookies to store information such as whether a user has been to the website before, the timestamp of the visit and the referrer site that directed the visitor to the website.

HubSpot

HubSpot uses cookies or similar technologies to analyse trends, administer the Perceptive Group Ltd websites, track users’ movements around these websites, and to gather demographic information about our user base as a whole. HubSpot keeps track of the Perceptive Group Ltd websites and pages you visit within HubSpot. This data is used to deliver customised content and promotions to users whose behaviour indicates that they are interested in a particular subject area. You are free to explore the Perceptive Group Ltd websites without providing any personal information. Personal information will only be collected if you choose to submit your information through an online form.

Hotjar

Hotjar analyses the online behaviour and voice of website users, by combining both analysis tools and feedback tools. This is achieved through tracking code which provides a script to your computer or device. The script captures specific data related to your interaction with a particular webpage. 

Hotjar may collect and process this information which is automatically and passively collected, whilst you navigate through and interact with the content on the Perceptive Group Ltd websites, together with information on your device or computer (such as cookies).

The sole purpose of passively collecting your information is to improve your experience when using the Perceptive Group Ltd websites.

QuestionPro is the platform used to manage our research panel community. QuestionPro stores information through user input, cookies, log files, and user surveys to create a “profile” of preferences to provide our panel members with more tailored surveys. How long we keep your personal Information

We will retain your personal information for as long as is necessary in accordance with our services, and to comply with our legal obligations. If you no longer want us to use your personal information, you may request that we erase your personal information. We will take reasonable steps to destroy or securely delete your personal information in accordance with our document retention policy.

Holding, Correcting, and Updating

We are based in New Zealand and any personal information that you provide to us will be collected, held (unless contractually not required to) and processed by us in New Zealand. Under the NZ Privacy Act 2020 you have rights of access to and correction of personal information that we hold. We offer the ability to correct or change the information collected at any time and as often as necessary.

You have the following rights in relation to the personal information we hold about you:

  1. Your right of access.
    If you ask us, we’ll confirm whether we’re processing your personal information and, if so, provide you with a copy of that personal information (along with certain other details). If you require additional copies, we may need to charge a reasonable fee.
  2. Your right to rectification.
    If the personal information we hold about you is inaccurate or incomplete, you’re entitled to have it rectified. If we’ve shared your personal information with others, we’ll let them know about the rectification where possible. If you ask us, where possible and lawful to do so, we’ll also tell you who we’ve shared your personal information with so that you can contact them directly.
  3. Your right to erasure.
    You can ask us to delete or remove your personal information in some circumstances such as where we no longer need it or if you withdraw your consent (where applicable). If we’ve shared your personal information with others, we’ll let them know about the erasure where possible. If you ask us, where it is possible and lawful for us to do so, we’ll also tell you who we’ve shared your personal information with so that you can contact them directly.
  4. Your right to restrict processing.
    You can ask us to ‘block’ or suppress the processing of your personal information in certain circumstances such as where you contest the accuracy of that personal information or you object to us processing it. It won’t stop us from storing your personal information though. We’ll tell you before we lift any restriction. If we’ve shared your personal information with others, we’ll let them know about the restriction where it is possible for us to do so. If you ask us, where it is possible and lawful for us to do so, we’ll also tell you who we’ve shared your personal information with so that you can contact them directly.
  5. Your right to data portability.
    With effect from 25 May 2018, you have the right, in certain circumstances, to obtain personal information you’ve provided us with (in a structured, commonly used and machine-readable format) and to reuse it elsewhere or to ask us to transfer this to a third party of your choice.
  6. Your right to object.
    You can ask us to stop processing your personal information, and we will do so, if we are:
    1. relying on our own or someone else’s legitimate interests to process your personal information, except if we can demonstrate compelling legal grounds for the processing; or
    2. processing your personal information for direct marketing.
    3. Your rights in relation to automated decision-making and profiling.

    You have the right not to be subject to a decision when it’s based on automatic processing, including profiling, if it produces a legal effect or similarly significantly affects you, unless such profiling is necessary for entering into, or the performance of, a contract between you and us.
  7. Your right to withdraw
    If we rely on your consent (or explicit consent) as our legal basis for processing your personal information, you have the right to withdraw that consent at any time.
  8. Your right to lodge a complaint with the supervisory authority.
    If you have unresolved concerns, you have the right to complain to data protection authorities. The relevant data protection authority will be the data protection authority of the country: (i) of your habitual residence; (ii) of your place of work; or (iii) in which you consider the alleged infringement has occurred.

If you would like to access, review, update, rectify, and delete any Personal Information we hold about you, or exercise any other data subject right available to you under the EU General Data Protection Regulation (GDPR) or NZ privacy policy, contact us at privacy@perceptive.co.nz. Our privacy team will examine your request and respond to you as quickly as possible.

Please note that we may still use any aggregated and de-identified Personal Information that does not identify any individual and may also retain and use your information as necessary to comply with our legal and/or contractual obligations, resolve disputes, and enforce our agreements

Children’s Privacy

Protecting the privacy of the young, i.e. children under the age of 13, is especially important. For that reason, we never collect or maintain information for our services from those we know are under 13, and no part of our services are structured to attract anyone under 13. If a child has provided us with personal information, we ask that a parent or guardian of the child contact us at privacy@perceptive.co.nz if they would like the information submitted by the child deleted from our database. We will use all reasonable efforts to delete such information from our database.

Changes to Policy

We reserve the right to change this policy at any time by notifying site and service users of the existence of a revised privacy policy.
